About
KK Sharma having single-handedly drafted the Indian Merger Regulations and enforcing them successfully, for the first time, helped Mr. Sharma to be known as the ‘Architect of Indian Merger Review Format’. Though starting as a Competition Law boutique firm, the Firm has grown to cover nearly all areas but more prominently Environmental and IPR Laws, Enforcement and Investigation Framework, International Trade, Tax and Public Affairs.
Be it Competition Law, Tax, Environment or any other law, or the related litigation, very path breaking and unique approaches, in handling matters, have almost always been appreciated by the concerned authorities and courts alike. In addition to practicing law, the academic contributions on various topics are requested from the Firm and appreciated across the world. Two books, on Competition Law alone, having been written by the Founder Mr. Sharma, along with the contribution of different chapters on Indian context of different laws in the international publications such as Global Competition Review, Asian Competition Review, Competition Policy, International Cooperative Legal Guide etc., as well as a stream of articles on various aspects of law including competition law give a very good grounding to the Firm.
Because of his seminal contribution in development of competition law in India by way of contributing to drafting of the law, regulations and heading all the three divisions - Investigation, Mergers and Antitrust - while being in the Competition Commission of India, the founder of the Firm, Mr. Sharma, has also been hailed as the ‘Father of Indian Competition Law’ by media.
He himself has laid down the competition law investigation framework in the country, as the very first Director General (DG) of the functional Competition Commission of India, guiding the client enterprises, the deft navigation during the investigation progress, before the DG, comes naturally to the Firm. It ensures that, later, when the DG report is submitted to the Commission, the chances of imposition of penalty are nipped in the bud as the enterprises are gently guided out of the harm’s path even while being subjected to investigation before DG. This involves not just overall guidance in the strategy of investigation but also constant hand holding in planning of oral testimony, actual recording of the oral testimonies/interviews and post interview follow up. Other areas where his expertise are Enforcement & Investigationbe it either Serious Fraud Investigation Office or Enforcement Directorate or Anti- Corruption Law, Commercial Law, India Business Entry, Arbitration, Drafting of Agreements, Litigation and Transfer Pricing, IPR Laws and, in some cases, even high stake criminal matters, covering nearly all the sectors of the economy. In this direction, the Firm has a wide experience of having dealt across sectors such as Automobiles, Power Generation and Transmission, Retail, Real Estate, Shipping Industry, Liquor, Insurance, Ports, Pharmaceuticals, Banking and Finance, Bulk Transportation, Oil and Chemicals, Film Industry, Manufacturing Sector, Future Trading of Agricultural Commodities or Services of GPS Devices and many others.
